Our agency fulfils all the required compulsory and voluntary requirements needed to operate as an Estate Agent, Lettings Agent & Property Sourcing Agent, below are a list of organisations that we are either affiliated, policy holders and/or members.
Although we pride ourselves on our proactive, open, honest, upfront approach and provided the relevant information here on our website, there are is a selection of unscrupulous agents within the industry whom claim to be compliant however there details fail to be listed on the registrars, so we do encourage any investors or other clients; should you choose to use us or another provider, to carry out their own due diligence and check the details against the relevant online registers to ensure the protection provided is up to date and at the required levels of protection.

CLIENT MONEY PROTECTION (CMP)
Depending upon the type of client; Investor, Landlord or Tenant, and the reason for us holding their funds dictates the method of best practice used.
For Investors we maintain HMRC’s AML recommendations and ensure that funds are lodged and held with the companies chosen solicitor, whom has the duty of care to protect the funds in the same way as we would in house, however this method ensures that there is a level of independence.
For Landlords where we collect and hold rents, we have a ring fenced account that is legally separate from the Lettings business bank account, ensuring that all rents collected awaiting to be paid to landlords are fully protected in the event of business failure.
For Tenants we protect any funds; that are paid to us and held as bonds against rental agreements, by placing them into an authorised tenancy deposit protection scheme within 30 days of receipt. This fully protects your funds in the event of business failure of either our lettings business or that of the landlord. It also adds a level of protection of the funds against unauthorised deductions during or at the end of a tenancy, ensuring disputes are settled fairly.
There are three schemes available and we reserve the right to choose which we use on an individual basis, however you will be told at the start of your tenancy:

BUSINESS INSURANCE
As any business we are legally required to carry a minimum level of insurance, however as Property Up North operate within the Property and Investment industries we understand that these minimum levels would barely protect our clients; with the values of assets they hold, which is why we go above and beyond to protect ourselves, our trusted clients and the public in which we come into contact. No one every wants to claim against a policy, however you should always consider if the safety net you are been provided is sufficient for your level of business. It also pays to carry out due diligence to ensure you are covered prior to engagement. We are able to provide you with the relevant schedules, names of Brokers, Underwriters and Insurers should you wish.
Professional Indemnity: £250,000 for any one claim plus defence costs.
Public Indemnity: £2,000,000 for any one claim plus defence costs.
Product Indemnity: £2,000,000 for any one claim plus defence costs.
HMRC Anti-Money Laundering (AML)
Alongside our Anti-Money Laundering Policy (HERE) we are required to register with HMRC under the categories of Estate Agency, Lettings Agency and Property Sourcing as we are involved in the ‘trading of high value assets & property’.
THE INFORMATION COMMISSIONERS OFFICE (ICO)

The ICO require anyone that holds confidential or sensitive information to hold a registration and ensure that all the data is collected, processed and stored in a safe secure manner, as Property Up North hold such data for various people and companies, we are registered with the ICO and have the following membership ZA791987 which can be checked HERE by downloading the Register and Searching either ‘Property Up North’ or ‘ZA792987’
